Privacy Policy
NAES values individual privacy. We want to give you the opportunity to know what information we collect about you and how you can limit its use beyond the purposes for which you first provided it. At all times, however, NAES reserves the right to disclose information where required by law or to comply with valid legal process (such as a search warrant, subpoena or court order), to protect NAES’ rights or property, including without limitation in the event of a transfer of control of NAES or substantially all of its assets, or during emergencies when safety is at risk.
Whenever we change our policy, we will give reasonable notice by posting a notice on our home page. Since these policy-change-notices last only for a limited time, however, you should check this Privacy Policy regularly to see if there have been any changes.
Generally, NAES uses data collected to improve its own web content; to respond to visitors’ interests, needs, and preferences; and to develop new products and services. It is our general policy to collect and store only personal information that our members and visitors knowingly provide.
General Users
NAES does not collect any personal information from you when you simply browse our website. Only aggregate data are collected. We use this data for internal and marketing purposes and do not provide any personally identifying information.
From NAES’ Members, Conference Registrants, and Other Customers
To access members-only resources and personalization features on episcopalschools.org, you are asked to register and provide some limited information. This information is submitted voluntarily.
NAES asks you to provide your name, title, organization name, business address, business telephone and fax numbers, and email. Similar information may be submitted to NAES through membership applications, the annual organization database update process, conference or seminar registration, publication orders, subscriptions, and contest registrations. If you purchase a product or register for a conference/event at our site, we will also ask for your credit card number or other account number you wish to be charged.
Additionally, for some emails sent in HTML format by NAES to its members through its forums and electronic newsletters, we will collect specific information regarding what the recipient does with that email. For those emails, NAES will monitor whether a recipient subsequently clicks through to links provided in the message. Other information collected through this tracking feature includes: email address of a user, the date and time of the user’s “click,” a message number, name of the list from which the message was sent, tracking URL number and destination page. NAES only uses this information to enhance its products and distribution of those products to its members. This information is not sold or distributed in any other manner.
Credit Card Account Information
NAES does not disclose credit card account information you provide. When you choose to pay using a credit card, NAES submits the information needed to obtain payment to the appropriate clearinghouse.
Children’s Privacy
NAES’ website is intended for adults. NAES does not knowingly collect personal information from children under the age of 13. If NAES obtains knowledge that it has personally identifiable information about a child under 13 in retrievable form in its files, NAES will delete that information from our existing files.
Disclosures to Third Parties
NAES makes member contact information available to other members using our website through the Members’ Directory and to people who register for or organizations that sponsor our conferences/events. On occasion, NAES may also provide limited data to third parties that offer products and services. These limited data include names, job titles, companies, and business addresses, but do not include business phone numbers, business fax numbers or email addresses.
We want to be sure that we keep only the most accurate and up-to-date information about you in our records. Therefore, whenever you believe that your contact information needs to be updated, you can email us at info@episcopalschools.org to correct or update your contact information.
You may choose at any time to remove your name, telephone and fax numbers, and postal and email addresses from the lists we use to send notices or updates and elect not to receive correspondence from us by emailing at info@episcopalschools.org to correct or update your contact information.
Users may request that NAES refrain from disclosing to third parties the data it collects on its forms on which users are providing information by checking the “opt-out” box that appears on each form on which a user provides information. Alternatively, you may email us at info@episcopalschools.org to correct or update your contact information.
Other Internet sites you visit—including those linked from the NAES website—may have their own privacy policies or no policy at all. Other websites might use personal information differently than our policy permits. We strongly encourage you to review the privacy policies of any site before providing any personal information.
Cookies are files that contain information created by a web server that can be stored on your hard disk for use either during a particular session (“per-session” cookie) or for future use (“persistent” cookie). NAES uses cookies only to facilitate automated activity, store and track passwords, and review navigation patterns. We do not use them to collect or disseminate significant information about you over the Internet or to analyze any information that you have knowingly or unknowingly provided.
When you log in, the system will ask whether you approve of the attachment of a cookie. You may instruct your Internet browsers to opt out of accepting a “persistent” cookie and rather accept only a “per-session” cookie, but you will need to login each time they visit the site to enjoy the full benefits. If you decline the attachment of any cookie, you may not have access to the full benefits of the website.
Using cookies, our web server automatically collects information when you visit our site, including your Internet Protocol (IP) address, the computer’s operating system, the type of browser you use, and the specific web pages visited during your connection. We may also track data such as the total number of visits to our website and the number of visitors to each page of our website. We may use this information, in aggregate form, for system maintenance and to better understand how our visitors use our site and services so that we can make them better.
NAES, and our vendors, use state-of-the-art technology to keep any information you provide as secure as possible. We also have in place privacy protection control contractual obligations with our vendors designed to ensure that personal data is protected from unauthorized access or disclosure. All NAES employees must abide by NAES’ Privacy Policy. Only authorized employees are permitted to have access to personally-identifiable data about website visitors, and that access is limited to what is reasonably needed to perform an employee’s responsibilities, such as providing updates or notices or customer service. Registration as a User for access to certain areas of this Site requires both a user name and a password. Only one User can use one user name and password and, thus, one account. By limiting access, it helps avoid unauthorized usage by other persons or entities because anyone with knowledge of both your user name and password can gain entry to the restricted portions of this Site and to your account. This TOS has been made in and will be construed and enforced in accordance with the laws of the State of New York as applied to agreements entered into and completely performed in the State of New York. You agree to the personal jurisdiction by and venue in the state and federal courts in the State of New York and waive any objection to such jurisdiction or venue. Any claim you might have against NAES must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. NAES makes no representation that this Site is appropriate or available for use in other locations, and access to this Site from territories or nations where any aspect of this Site is illegal is prohibited. You access this Site on your own volition and are responsible for compliance with all applicable local laws with respect to your access and use of this Site. A printed version of this TOS and of any related notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this TOS to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Actual or attempted unauthorized use of this Site may result in criminal and/or civil prosecution, including, without limitation, punishment under the Computer Fraud and Abuse Act of 1986 under U.S. federal law. NAES reserves the right to view, monitor, and record activity on this Site without notice or permission from you, including, without limitation, by archiving notices or communications sent by you through the Site. Any information obtained by monitoring, reviewing, or recording is subject to review by law enforcement organizations in connection with investigation or prosecution of possible criminal or unlawful activity on the Site as well as to disclosures required by or under applicable law or related government agency actions. Moreover, as a member with NAES, you acknowledge and agree that violations of this TOS may result in a revocation or suspension of your membership status with NAES.
You acknowledge that any breach, threatened or actual, of this TOS will cause irreparable injury to NAES, such injury would not be quantifiable in monetary damages, and NAES would not have an adequate remedy at law. You therefore agree that NAES shall be entitled, in addition to other available remedies, to seek and be awarded an injunction or other appropriate equitable relief from a court of competent jurisdiction restraining any breach, threatened or actual, of your obligations under any provision of this TOS. Accordingly, you hereby waive any requirement that NAES post any bond or other security in the event any injunctive or equitable relief is sought by or awarded to NAES to enforce any provision of this TOS.
This TOS will take effect at the moment you click “I ACCEPT”, register, respond to a request for information, and/or begin downloading, accessing, or using this Site, whichever is earliest. NAES reserves the right at any time and on reasonable grounds, which shall include, without limitation, any reasonable belief of fraudulent or unlawful activity or actions or omissions that violate any term or condition of this Agreement, to deny your access to this Site or to any portion thereof in order to protect its name and goodwill, its business, and/or other Users, and this TOS will also terminate automatically if you fail to comply with its terms and conditions, subject to the survival rights of certain provisions identified below. Termination will be effective without notice. You may also terminate this TOS at any time by ceasing to use the Site, but all applicable provisions of this TOS will survive termination, as identified below. Upon termination, you must destroy all copies of any aspect of this Site in your possession. The provisions concerning NAES’ proprietary rights, feedback and submissions, indemnity, disclaimers of warranty and liability, admissibility of this TOS, waiver and severability, entire agreement, and governing law will survive the termination of this TOS for any reason.
Failure to insist on strict performance of any of the terms and conditions of this TOS will not operate as a waiver of any subsequent default or failure of performance. No waiver by NAES of any right under this TOS will be deemed to be either a waiver of any other right or provision or a wavier of that same right or provision at any other time. If any part of this TOS is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and the liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most clearly matches the intent of the original provision and the remainder of this TOS shall continue in effect.
No joint venture, partnership, employment, affiliate, or agency relationship exists between you and NAES as result of this TOS or your utilization of this Site. This TOS, NAES’ Privacy Policy, and any other agreement or terms or conditions for services, donations, programs, or licenses for materials, information, or services available through the Site, which are all hereby incorporated by reference as if set forth fully herein, represent the entire agreement between you and NAES with respect to use of the Site, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written between you and NAES with respect to this Site. You may not assign or transfer any rights under this Agreement without the prior written consent of NAES. Please note that NAES reserves the right to change the terms and conditions of this TOS and the terms and conditions under which this Site and its many offerings are extended to you by posting a revised TOS or mailing and/or e-mailing notice thereof to you. In addition, NAES may add, modify, or delete any aspect, program, or feature of this Site, but NAES is not under any obligation to add any upgrade, enhancement, or modification.
